Terms of Service

1. Service

OnTalkies, Inc. ("OnTalkies", "we") operates ontalkies.com, a pay-per-view streaming service available only to viewers physically located in the United States. By using the service, you agree to these Terms.

2. Eligibility and territory

You must be at least 18 years old, located in the United States, and capable of forming a legally binding contract. Using a VPN, proxy, or other anonymization technology to circumvent our geographic restrictions is a material breach of these Terms.

3. Rentals and refunds

A successful purchase grants a single-account, time-limited license to stream the purchased film for 48 hours from the moment playback first starts. Once playback has started, the rental is non-refundable. Refunds for non-played rentals may be requested within 7 days of purchase via support@ontalkies.com.

4. Account and devices

Up to three (3) devices may be registered to a single account. Concurrent streaming is limited to one (1) device at a time during MVP, and to the number permitted by your subscription tier thereafter. We may end any session if a newer login starts elsewhere.

5. Anti-piracy

The service uses dynamic visible watermarks, forensic watermarks, encrypted transport, device binding, and other measures to identify the source of any redistributed content. You agree not to record, screen-capture, copy, redistribute, decompile, or otherwise interfere with the service or its content. Violation will result in account suspension and may result in civil and criminal penalties under 17 U.S.C. § 506 and 18 U.S.C. § 2319.

6. DMCA

We respect copyright. Notices of claimed infringement should be sent to our designated DMCA agent at dmca@ontalkies.com. See our DMCA policy for required notice contents and counter-notice procedures.

7. Content rights

All films are licensed for the United States only and only for the durations indicated on the film's detail page. We do not grant any download, broadcast, or public-performance rights. Films may become unavailable when the license window closes.

8. Privacy

Our handling of your data is described in our Privacy Policy.

9. Disclaimers and liability

The service is provided "as is". To the maximum extent permitted by law, OnTalkies disclaims all warranties and limits its liability to the amount you paid in the prior twelve months.

10. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws. Disputes will be resolved by binding arbitration under the AAA Consumer Arbitration Rules in Delaware.
